Principal Sessions Judge Pulwama Abdul Rashid Malik awarded life-imprisonment to Sameer Ahmad Sheikh and Javid Ahmad Shah. As per the brief facts of story, complainant, namely Ghulam Ahmad Wani approached SHO Police Station Pulwama on April 2, 2011 with a written complaint stating that his grandson namely Khursheed Ahmad Wani, son of Sonaullah Wani left house on March 25, 2011 with an accused. The complainant further mentioned that he got the information that his grandson has stayed in house of accused No.2 but despite passage of 5 days, he has not returned back.
Before this, as per the police report on April 2, 2011 Police Station Pulwama received an information through reliable source that at village Murran under heap of cow dung a blood-stained dead body is lying who has been killed mercilessly by some unknown persons. This information culminated into registration of FIR under section 302 of RPC and Police machinery came into motion and investigation started, during which complaint as mentioned hereinabove was also filed by grandfather of the deceased.
Principal Sessions Judge Pulwama Abdul Rashid Malik while awarding life-imprisonment to both accused, observed that deceased was a young boy of 18 years at the time of his death and was undergoing studies in B.A 2nd year. “The criminal justice system has to address plight of victim also. Mere punishment will not satisfy the victim who has suffered as a result of commission of the crime. The mother of deceased has died.
His father is alive, who was out of his home on the date of brutal murder of his son at hands of the accused and asked Member Secretary, J&K Legal Services Authority, to release an amount of Rs 2 lakh in favour of father of deceased namely Nisar Ahmad Wani,” the Court directed.
