Delhi special team raids Kashmir based distributor of Punjab company for infringement of trade mark

Srinagar, Sep 21, 2017: A special team constituted by Patiala House Court New Delhi raided the premises of  G.M.A Cooperative Marketing Limited, Gousia Shop, Gulmarg Road Magam here in Central Kashmir after a complaint from a plaintiff that the dealer has been importing cattle feed from a Chandigarh based company that has infringed the trade mark of his company.

The special team assisted by a party from Jammu Kashmir police team seized over 2000 bags of cattle-feed from the godown G.M.A Cooperative Marketing Limited while a truck (PB13/AW4031) carrying ‘sub-standard’ cattle feed was also seized by the police.

Rajhstan based M/s Shree Krishna Roller Flour Mill had filed a law suit in the court of Additional District Judge Patiala House New Delhi, Veena Rani that a Punjab based Megastar Foods Private Limited has infringed his ‘K Diamond’ trade mark and has been supplying cattle feed in Kashmir using ‘K Diamond Chokar’ thus not only cheating customers but also causing financial losses to the company.

The plaintiff in his law suit claimed that Megastar Foods Private Limited which distributes cattle feed to Kashmir based distributor G.M.A Cooperative Marketing Limited is not the proprietor of the impugned Trade Mark and have adopted and are having intention to use the same as a Trade Mark in relation to its impugned goods and business and also reproducing them on their labels and packaging materials.

Taking cognizance of the law suit, the court constituted a special team and raided the premises of Megastar Foods Private Limited Roopar Punjab and G.M.A Cooperative Marketing Limited, Magam Kashmir.

The court also observed that a company cannot use the trade mark of a popular company and thus cheat the customers.

Confirming the raid on the premises of G.M.A Cooperative Marketing Limited, Magam Kashmir, a police official said that they followed the directions of Delhi court.

An official from Rajhstan based M/s Shree Krishna Roller Flour Mill told news agency  that both the company and the distributor violated the law and cheated the customers. “Thousands of customers in Kashmir have been purchasing their brand taking it as our product. This is cheating and we request customers not to fall to such tactics,” he said.
