Ganderbal Court on Tuesday has Convicted four accused Person’s for outraging modesty of woman in year 2016. Sources told that Chief Judicial Magistrate Ganderbal has convicted four accused persons for causing criminal trespass, inflicting injury to the complainant and outraging modesty of his wife.
According to news agency on 15 April 2016, Complainant approached Police station kherbawani Ganderbal with a written application that the accused persons without any reason entered the courtyard and started abusing and were shouting that his children had hurdled abuses to their children when the two were playing with each other and when he objected, the accused persons caught hold of him and beat him in the courtyard itself, the accused person also tore the clothes of his wife .
Accordingly after Registration of FIR, the challan of the case was filed by Police in the court of CJM Ganderbal and accused were charged for the commission of above offences.
After hearing the final arguments of prosecution and defense counsels, the accused persons were found guilty in the above-said offences, as the prosecution was able to prove the case beyond any shadow of doubt.
The accused persons were convicted in the offence U/s 323 & 447 RPC and were awarded the imprisonment of six months for the offence U/s 323 RPC and Two months for the offence U/S 447 RPC and the fine to the tune of Rs. 2000/- each.
“Accused Bashir Ahmed Bhat has also been convicted for the imprisonment of One Year for the offence U/S 354 RPC, for outraging the modesty of the wife of the complainant & a fine of Rs. 5000/- which shall be paid to the lady victim by Accused No. 1”, reads the order.
However, all the punishment shall run concurrently. The UT was represented by Additional Public Prosecutor CMJ Court Ganderbal Iftikhar Ul Hassan.
Accused Person’s were identified as Bashir Ahmad Bhat S/o Ghulam Rasool Bhat , Altaf Ahmad Dar , Shareif ud din Dar and Sameer Ahmad Dar Residents of Mashkpora Tulmulla Ganderbal. ( CNS )
