Jammu and Kashmir government on Thursday said that it can’t pay compensation to human shield victim Farooq Ahmad Dar as there was no allegation of violation of his human rights against the state.
“That no allegations as regards violation of human rights of the applicant have been leveled against the state government or any of its functionary. The state government has discharged its obligation by registering an FIR no. 38/2017 in the matter at PS Beerwah and consequently initiating the investigation,” the Chief Minister Mehbooba Mufti said while replying to a written question of senior NC leader Ali Muhammad Sagar in the assembly.
The government said that paying of compensation to Dar who was tied to the bonnet of the armored vehicle by army’s Major Leetul Gogoi on the day of Parliamentary polls in April last year would “tantamount to establish the guilt of the accused without affording him of an opportunity of being heard”.
“That pending completion of the investigation in the matter, the recommendation with regard to payment of compensation to the complainant, shall tantamount to establish the guilt of the accused without affording him of an opportunity of being heard,” it said.
In the reply, the government also termed as “handicapped” the State Human Rights Commission which had recommended a compensation of Rs 10 lakh to Dar.
It also said that SHRC lacks domain to go into the conduct of the Army .
