Srinagar Police Secures Conviction In 2020 Maisuma Murder Case : Court Sentences Accused To Life, Orders Compensation

Srinagar, Aug 7 : Srinagar Police has secured conviction in a six-year-old murder case with a court awarding life imprisonment to the accused.

The case pertains to FIR No. 03/2020 registered at Police Station Maisuma.

The police said that the Hon’ble Court convicted Ghulam Mohi-ud-Din Dar, son of Abdul Gani Dar and resident of Bichwara, Dalgate, Srinagar, for the murder of Abdul Gani Dar, son of Mohd. Abdullah, a resident of Rassu, Budgam. The offence was proved under Section 302 of the Indian Penal Code.

While pronouncing the quantum of sentence, the court observed that though the crime was grave and brutal, it did not qualify as the “rarest of rare” to merit capital punishment. The convict was therefore sentenced to rigorous imprisonment for life and directed to pay a fine of ₹50,000.

The court said that if the fine is realized, it shall be handed over to the legal heirs of the deceased as compensation. The accused has also been given the benefit of set-off for the time already spent in judicial custody.

Taking serious note of the circumstances, the court remarked that the assault took place inside a mosque. It said such violence in a place of worship affects public peace, communal harmony and the sanctity of religious institutions.

Considering the hardships faced by the victim’s family and the dependence of his children, the court also ordered payment of ₹7 lakh as victim compensation under the Jammu & Kashmir Victim Compensation Scheme, 2019. The amount will be disbursed through the J&K State Legal Services Authority within the prescribed time.

Officials said the conviction was achieved due to a thorough investigation by Srinagar Police and sustained prosecution before the court.

Srinagar Police stated that it remains committed to delivering justice to victims through professional investigation, scientific evidence and diligent follow-up in courts, reads the statement.
