HC Takes Note of Changed Circumstances, Grants Anticipatory Bail
SRINAGAR, May 22 : The High Court of Jammu & Kashmir and Ladakh has granted anticipatory bail to an Army soldier accused in a sexual exploitation and POCSO case registered in Kathua district after the complainant informed the court that she had married the accused and no longer wished to pursue the case.
According to court proceedings, the woman stated before the High Court that the FIR was lodged under pressure from relatives and police officials. She further informed the court that she had subsequently married the accused and the couple was now living together peacefully.
The case involved allegations of sexual exploitation and offences under the Protection of Children from Sexual Offences (POCSO) Act registered at a police station in Kathua.
While hearing the anticipatory bail application, the High Court considered the changed circumstances, including the marriage between the complainant and the accused as well as the statement made by the woman before the court.
After hearing the matter, the court granted anticipatory bail to the accused soldier subject to conditions laid down in the order.
