Shifting of service matters of employees of J&K, Ladakh UTs to Chandigarh bench unacceptable: Shah Fayaz

 President J&K employees coordination committee Shah Fayaz in a statement said this is very serious issue and also against employees of j&k and Ladakh UTs.

Decision taken by the Union Govt, by virtue of which all employees/Pensioners of the Jammu, Kashmir and Ladakh are henceforth supposed to approach Central administrative tribunal in Chandigarh for redressal of their grievances.

Shah took a strong exception to the order issued by department of Personal and training (DOPT) by way of which Central administrative tribunal has been reconstituted and it’s jurisdiction extended to employees of UT of Jammu and Kashmir & Ladakh.

Shah said the whole employees of Jammu and Kashmir are against this decision of govt and alleged that it will restrict jurisdiction of J & K High court over the service issues of the employees of UT of Jammu and Kashmir & Ladakh.

He said this move is against the wishes of employees of J & K and Ladakh as it would not be possible for employees to travel to Chandigarh for redressal of their service matters.

Shah describes the move as an attack on the high court and it’s constitutional power of judicial review. He said that the tribunal had been deliberately created to nibble away the high court’s jurisdiction.

Shah said the shifting of all service matters of employees including increments, promotions, pension, dismissal and termination of all employees even the service matters of daily wagers has been shifted to CAT is nothing but a waste of time and money of the employees and added that this move will adversely affect the lawyers fraternity of UT of Jammu and Kashmir & Ladakh

Shah urged upon the GOI to establish two tribunals for Jammu and Srinagar for the redressal of service matters of employees of UT J&K and Ladakh and added that the move will give a sigh of relief to the state employees who are already under stress because adverse working conditions.

Shah hoped that GOI will listen to the genuine and legitimate demand of the employees at an earliest and demanded immediate withdrawal of the order in the interest of welfare of employees and unemployed youth of UT of Jammu and Kashmir & Ladakh.
